Mapit GIS Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Mapit GIS mobile applications and related services (the "Service") provided by Mapit GIS Ltd. ("Company", "we", "us", or "our"), a company registered in the United Kingdom.

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms​

By accessing or using the Service, you (or your parent or guardian on your behalf if you are a minor) agree to comply with and be bound by these Terms and our Privacy Policy.

2. Description of Service​

Mapit GIS is a professional Geographic Information System (GIS) application for field data collection. The Service allows users to capture, manage, and export spatial data using the GeoPackage format.

The Service is available in the following tiers:

  • Free Tier -- Provides basic GIS functionality with limits on the number of projects, layers, and features.
  • Pro Subscription -- Removes all limits and unlocks additional features including full format import/export, offline maps, online map services, GPS track recording, GNSS integration, and position averaging.

3. Subscriptions and Payments​

Auto-Renewable Subscriptions​

Mapit GIS Pro is offered as an auto-renewable subscription through Apple's App Store. By purchasing a subscription:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Management: You can manage and cancel your subscriptions in your Apple ID account settings or through Settings > Subscription within the app.
  • Price changes: If the subscription price increases, you will be notified and required to agree before the renewal at the new price.

Apple's Standard EULA​

Your use of the Service is also subject to the Apple Licensed Application End User Licence Agreement, which is incorporated into these Terms by reference.

Refunds​

Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly. To request a refund, visit Apple Support.

Free Trial​

If a free trial is offered, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless cancelled beforehand.

4. User Responsibilities​

You agree to:

  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Not attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Not use the Service to transmit any malicious software or harmful code.
  • Maintain the security of your device and any data stored within the application.
  • Ensure that your use of the Service complies with all applicable local, national, and international laws and regulations.

5. Data and Privacy​

All survey data, geographic features, and attachments are stored locally on your device. The Service is designed with an offline-first approach and does not upload your data to external servers without your explicit action.

6. Intellectual Property​

The Service, including all content, features, and functionality, is owned by Mapit GIS Ltd. and is protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal or professional purposes in accordance with these Terms.

7. Third-Party Services​

The Service integrates with third-party services including:

  • Mapbox for map rendering and search functionality
  • NGA GeoPackage Libraries for spatial data management
  • Online map services (WMS, WFS, WMTS, XYZ) that you configure

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

8. Disclaimer of Warranties​

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • GPS or GNSS positioning data will be accurate to any particular standard.
  • The results obtained from using the Service will be accurate or reliable.

You are solely responsible for verifying the accuracy of any data collected using the Service. The Service should not be used as the sole basis for any decision where inaccurate spatial data could result in harm, injury, or significant financial loss.

9. Limitation of Liability​

To the maximum extent permitted by applicable law, Mapit GIS Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Indemnification​

You agree to indemnify and hold harmless Mapit GIS Ltd., its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

11. Changes to These Terms​

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

12. Termination​

We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will cease immediately. All data stored locally on your device remains your property.

13. Governing Law​

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability​

If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
